e-HQ Main Website Terms of Service

The following terms and conditions are fully binding, by accessing the service you will be deemed to have accepted them and to be bound by them.

  1. A fully paid up Account gives the registered owner access to the members area of our website and all the related services and features, and hosting of your own web site for a period of 12 months (subject to our Acceptable Usage Policy).

  2. You remain responsible for all telephone call charges that you incur while accessing the service.

  3. Webhosting Accounts include 1000MB of transfers per calendar month, bandwidth usage over and above this allocation will be charged at £10 per additional gig transferred. This charge is normally levied at the end of each calendar month, if payment is not made immediately on request we reserve the right to disable your web site. In exceptional circumstances we may seek to be re-imbursed for bandwidth usage prior to the end of a calendar month, again if payment is not made on request we reserve the right to disable your web site.

  4. No guarantee of availability of service and reserves the right to change, withdraw, suspend, or discontinue any functionality or feature of the service.

    IN NO EVENT WILL e-HQ, Artology, Cheapnet, PO Box Ltd., or our suppliers BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICES OR ANY CONTENT THEREON. THIS DISCLAIMER APPLIES, WITHOUT LIMITATION, TO ANY DAMAGES OR INJURY, WHETHER FOR BREACH OF CONTRACT, TORT, OR OTHERWISE, CAUSED BY ANY FAILURE OF PERFORMANCE; ERROR; OMISSION; INTERRUPTION; DELETION; DEFECT; DELAY IN OPERATION OR TRANSMISSION; COMPUTER VIRUS; FILE CORRUPTION; COMMUNICATION-LINE FAILURE; NETWORK OR SYSTEM OUTAGE; OR THEFT, DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF ANY RECORD.

    We do not guarantee that the service (including web hosting and email) will be free from interruptions or that the service will be free from errors. We may also have to suspend the service from time to time to carry out maintenance and to make upgrades to it. If we have to suspend the service we will try to give you as much notice in advance as possible on our site and through mailing lists.

  5. We are not responsible for the content of any Web Site other than our own. We will not be responsible to you for any loss or damage that you suffer by using the service (except where the use results in death or personal injury and is caused by our negligence).

  6. ALL registration information supplied to us by you must be true, complete and accurate. You must not impersonate any other person. You must notify us of any changes to the information immediately by logging into the online administrative console and choosing the "update details" option.

  7. You are responsible for the confidentiality of your username and password and must immediately notify us if you become aware that someone is making unauthorized use of them. If we believe that your username and password is being used by unauthorized persons we may suspend the service.

  8. You may terminate your account without penalty and without notice by ceasing to use the service, your membership is non-transferable and non-refundable. In the event that you wish to remove a domain to another service provider we will charge you an administration fee to effect the transfer, currently £39.99 (plus VAT at the prevailing rate). We will endeavour to process all transfers on which the administration fee has been paid within 4 working days.

  9. On occasion we may choose to tell you about new features to be added. No guarantee can be made for the provision of these services, nor their merchantability or fitness for purpose, therefore refunds cannot be offered for services that are not launched, or if any part of the service is withdrawn for technical, legal or ethical reasons.

  10. For customers who have taken advantage of FREE .uk domain registration the following special conditions apply

    1. The FREE registration of a domain is included in the price, the payment is NOT for the registration of that Domain Name as this is FREE (subject to conditions contained herein). Payment is for access to member services. 

    2. IN THE EVENT THAT YOU WISH TO REMOVE THE DOMAIN TO ANOTHER SERVICE PROVIDER YOU AGREE TO US CHARGING YOU AN ADMINISTRATION FEE, CURRENTLY £39.99 (+ VAT AT THE PREVAILING RATE), TO EFFECT THE TRANSFER. YOU AGREE THAT THIS FEE WILL BE DEEMED OWING ONCE WE HAVE RECEIVED THE TRANSFER REQUEST AND YOU ALSO AGREE THAT THE TRANSFER CANNOT HAPPEN UNTIL THIS AND ANY OTHER AMOUNTS OWING IN CONJUNCTION WITH THIS ACCOUNT ARE PAID IN FULL.

    3. For the purposes of administration of the domain name you agree to appoint us as your representative to complete the formalities with Nominet UK and to deal with Nominet UK on your behalf for the duration of our agreement; accordingly all your dealings with Nominet UK must be through us. When we register your domain name a record of ownership will be available to the public on the register maintained by Nominet UK. You must not intentionally ask us to register a domain name that infringes the rights of any other person and there can be no guarantee that your choice of domain name will be available. When the domain name is registered in your name you will also be subject to the terms and conditions of Nominet UK which are available for inspection at http://www.nic.uk/terms.html.

    4. The domain name remains free only if you remain a user of our service. In the event that you are not still a user of our service on the second anniversary of the domain name being registered, Nominet UK may invoice you for the applicable renewal fee at the appropriate rate. In registering a domain name you are giving us full agent authority to act on your behalf, with regards to transferring and or deleting the domain name.

    5. We may terminate your account without notice, if you breach the Terms and Conditions of Nominet UK, the UK domain registrars.

    6. You agree to be bound by the Nominet UK Dispute Resolution service in the event that any other party claims to be entitled to the domain name you have registered.

  11. We are NOT responsible for the payment of renewals fees on domains that are not registered through Nominet UK.

  12. For customers who have subscribed to our unmetered Internet Dialup Service the following special conditions apply.

    1. Connection to the service will only be possible when using a BT Telephone Line with CLI (calling line identification) enabled (you may not connect to the service if you withhold your telephone number).

    2. You must not attempt to make more than one simultaneous connection to the service using only one set of access credentials.

    3. You must not attempt to make MPPP or other such bonded connections to our service (this is considered to be more than one simultaneous connection).

    4. You are limited to using the service for a maximum of 14 hours in any 24 hour period. 
      We reserve the right to permanently remove your unmetered dialup service if you abuse this clause.

    5. As this service is not intended to be used as an 'always on' service  you must not leave your connection to the internet idle or use a connection of any means that makes automatic unattended connections to the Internet.

    6. We reserve the right to temporarily disconnect you from the service if your connection is either idle for more than 2 minutes or you are connect for more than 2 hours.

  13. Consenting to the immediate provision of the service by Cheapnet Limited to you means you will have no right to cancel the provision of the service under the Consumer Protection (Distance Selling) Regulations 2000.

  14. We may terminate your account, without notice, if you breach these terms and conditions or our Acceptable Use Policies.

  15. We may vary the prices of it's services providing not less than one months notice to customers.

  16. We reserve the right to change or amend these Terms of Service at any time and without prior notice.
